The following terms and conditions are agreed to:

1. The student’s failure to attend lectures for whatever reason shall no way entitle him/her to a reduction in fees, nor will it absolve him/her or the other signatories to this document from full liability for the payment of fees and other charges.

2. The right to attend lectures and write exams is not transferable.

3. The signatories hereto accept that iCALC Training Academy (Pty) Ltd shall have the right to vary the course syllabus so it is in line with NQF requirements.

4. iCALC Training Academy (Pty) Ltd shall have the right at it's sole discretion to cancel tuition in any course or subject initially advertised and offered, on the basis of insufficient demand. iCALC Training Academy (Pty) Ltd further reserves the right to combine classes of a similar academic level and content.

5. iCALC Training Academy (Pty) Ltd reserves the right to create and apply rules (including due performance); and the student hereby agrees to be bound by such rules. iCALC Training Academy (Pty) Ltd reserves the right to exclude the students from lectures and examinations (without in any way detracting from the right of iCALC Training Academy(Pty) Ltd to recover fees payable), and withhold a student’s examination results or to dismiss him/her for failing to pay tuition fees or failing to comply with any rules or the terms of this contract. The students and other signatories hereby agree to pay any and all tuition fees as and when they fall due at iCALC Training Academy (Pty) Ltd. When failure to do so results in legal or other action being taken by iCALC Training Academy (Pty) Ltd, that liability for all costs relating to such actions will fall on any signatories to this contract other than iCALC Training Academy (Pty) Ltd, jointly and severally.

6. Fees payable to iCALC Training Academy (Pty) Ltd comprise tuition fees for iCALC Training Academy (Pty) Ltd and do not include external institute membership fees, examination fees, textbooks, stationery, accommodation or other items unless otherwise stipulated. Furthermore, it shall be the student’s responsibility to bear the cost of transport and specialized consumables used during the course including but not restricted to specialized stationery, film/video stock or any other material.

7. The signature hereby accepts that iCALC Training Academy (Pty) Ltd shall have the right to write off funds paid in advance within 12 months from date of payment, excluding Trust accounts).

8. The student, is responsible for ensuring that he/she has been properly registered with any relevant external institute or examining body, where applicable and that he/she has been registered for examination with such institute or body.

9. In the case of vis major, iCALC Training Academy (Pty) Ltd reserves the right to cease lectures and close the college temporarily, while every effort will be made to resume lectures as soon as possible no warranties are made in this regard and no refund in fees will be made.

10. No relaxation, variation or indulgence granted by iCALC Training Academy (Pty) Ltd to other signatories hereto in respect of this agreement shall constitute a waiver of any rights vesting in iCALC Training Academy (Pty) Ltd in terms hereto. Such other signatories further warrant that they have not relied on any term or representation not contained herein.

11. In the event of the signatories to this agreement, other than iCALC Training Academy (Pty) Ltd having completed this form incorrectly or the payment details herein not being in accordance with the requirements of iCALC Training Academy (Pty) Ltd, the incorrect information or payment details shall be deemed to have been amended so as to be in accordance with the requirements of iCALC Training Academy (Pty) Ltd, without further notice.

12. iCALC Training Academy (Pty) Ltd shall be deemed to include any division of iCALC Training Academy (Pty) Ltd or any other juristic person to whom the rights and obligations of iCALC Training Academy (Pty) Ltd, as contained herein may be ceded and/or assigned.

CANCELLATION POLICY

1. Should the student withdraw from the course the Registration fee plus deposit will not be refunded.

2. Should such withdrawal take place within the first two weeks of classes commencing, the student and/or sponsor will be liable to pay 50% of the course or subject fee plus the value of any books, stationery or equipment issued to the student and not returned in the same way the student received the course material and in a reusable condition.

3. Should such withdrawal take place more than two weeks after classes have commenced, then the student and/or sponsor will be liable to 100% of the course or subject fee.

4. Should the student defer from the course or a subject to a later occurrence of the same course or subject, then the student/sponsor will be charged as if the student has withdrawn, but will be entitled to a 50% discount of the re-enrolment should such deferral take place after classes have commenced.

5. Should the student transfer from the course or a subject to a different course or subject within two weeks of classes commencing, then the student and or sponsor will be liable to pay 100% of the course or subject fee.

1. If Academic period has commenced, NO REFUNDS will be made due to COVID-19 Retrictions, the contraction of the virus and/or the retraction of education, transport or any other guideline issued by the government or Department of Education.

CONDITIONS

1. The registration fee and full deposit is payable before classes commence and is non-refundable.

2. Should the student pay in full by the first Friday after the commencement of the trimester then he/she will qualify for a discount on the course fees only

3. The student and sponsor undertake to pay legal collection costs on an attorney and client scale. Including collection commission and tracing fees, should iCALC Training Academy (Pty) Ltd action for recovery of any arrear amounts.

4. The student and sponsor choose as their domicilium citandi, their physical address for the purpose of service of any courts processes. Summons and notices, should legal action flow from this agreement.

5. This is full agreement between the parties, and no indulgence granted by iCALC Training Academy (Pty) Ltd will be deemed to be a waiver of any rights of iCALC Training Academy (Pty) Ltd or operate as an estoppel.

6. No variation or consensual cancellation of this agreement will have any force or effect unless reduced to writing and signed by both parties.

7. Hereby agree to be liable/jointly and severally liable for the contract amount, subject to the policy and conditions as stipulated. I/We further agree that failure to attend lectures will not reduce my liability under this contract.

9. Please take note that if the full amount is paid for at registration, then the learner will qualify for a 2,5% discount on the class fee only.

10. Please take note that Students not attaining, with proof, of 80% attendance, the student is NOT permitted in accordance with the DHET’s registrations to write the examinations.

11. Please take note that Students need to qualify to write the exams by attaining a 40% iCASS mark for two (2) tests/assignments – This is in accordance with the DHET guideline.

12. It is the student’s responsibility to find out about important dates (Tests, Assignments, Exams).

13. I hereby agree to be liable/jointly and severally liable for the contract amount, subject to the policy and conditions and stipulated overleaf. I/We further agree that failure to attend lectures will not reduce my liability under this contract.

14. I acknowledge that I must pay 70% upon registration & 30% in, instalments before examinations start.

CODE OF CONDUCT

• Students are required to be punctual at ALL times. If a student is late for longer than 5 minutes he/she will NOT be allowed into the classroom.
• A MINIMUM of 80% attendance is required to write an examination for any course, in accordance with the Department of Higher Education & Training.
• All absenteeism should be accompanied by a doctor’s note or other supporting documents unless there has been prior arrangements with the college / Principal.
• Students may be dressed casually but neat at all times. No tank tops are allowed. Girls to be respectfully dressed at all times. No mini-skirts / shorts are allowed.
• The use of a CELL PHONE, EARPHONES or other ELECTRONIC DEVICES will not be permitted in class.
• No smoking is allowed inside the building (cigarettes, vapes, E- cigarettes).
• Ablution facilities are there for everyone, therefore let’s use and leave them in a clean state. All litter should be discarded in bins provided.

• Defacing of college property is strictly forbidden e.g. writing on the walls and desks.
• For a student to be permitted to write an examination, he/she should have written 2 Trimester tests OR completed 2 Assignments and achieved 40% or more, in accordance with the Department of Higher Education & Training. Therefore, please adhere to the prescribed test dates and only a doctor’s note, valid supporting documents or prior arrangements with the college will be acceptable for absenteeism.
• All complaints or suggestion should be dropped in the suggestion box at the reception area.
• The computer lab is restricted to computer classes only.
• Eating & drinking in classrooms is not allowed except for transparent bottle with water. At all times please leave all class rooms in a tidy state.
• Anyone found fooling around in the elevator will be found in contravention of our Code of Conduct & if any damages are incurred will be liable to settle any accounts and will also face a criminal charge.
• NO DRUGS, WEED or ALCOHOL ARE ALLOWED ON THE PREMISES OF THE COLLEGE. NO STUDENT WILL BE ALLOWED BACK ON THE PREMISES IF HE/SHE IS UNDER THE INFLUENCE OF THE ABOVE-MENTIONED SUBSTANCES IN BETWEEN CLASSES.
• Teaching and learning will be conducted in ENGLISH only.
• Students MUST be seated before 09:00 am during examinations, students arriving later than 09:00 am will not be allowed to enter the examination room / nor write his/her exam.
